ontōlogic ("we," "us," or "our") is committed to safeguarding the privacy and personal information of our users, clients, and community members. This Privacy Policy outlines our practices regarding the collection, use, disclosure, and protection of your information when you access our website hosted on System.io, participate in our community, or engage our consulting services.

By accessing or using our Services, you acknowledge that you have read this Privacy Policy and consent to the data practices described herein. This policy is drafted in compliance with the Protection of Personal Information Act (POPIA) of South Africa and aligns with international standards where applicable.

2. Information We Collect

We collect personal information that you voluntarily provide to us to facilitate the delivery of our services. This occurs when you:

  • Register for the ontōlogic Community or Goal Setting Programs.

  • Subscribe to our newsletters and curated resources.

  • Purchase digital products, workshops, or consulting packages.

  • Submit data via our "Strategic Alignment Assessment," "Workflow Audit," or other forms powered by Notion.

Types of Data Collected:

  • Personal Identification Data: Full name, email address, contact number, and billing address.

  • Business Intelligence Data: Information regarding business pain points, operational workflows, revenue brackets, and strategic goals.

  • AI-Processed Data: Non-sensitive business data used for strategic synthesis via Google Gemini.

  • Financial Transaction Data: We do not store or process credit card details on our servers. All financial transactions are processed through encrypted third-party payment gateways (including but not limited to Stripe, PayPal, and Paystack) integrated via System.io.

3. Use of Information & AI Disclosure

We process your information for the following legitimate business purposes:

  • Service Delivery: To facilitate the delivery of purchased workshops, consulting sessions, and automated resources.

  • Transaction Processing: To process payments, manage subscriptions, and issue invoices.

  • AI Synthesis (Gemini): We utilize Google Gemini to assist in analyzing business workflows and goal-setting data. We employ data-masking protocols to ensure that high-level strategy is processed without exposing unnecessary personal identifiers to AI models.

  • Communication: To distribute educational resources and community updates via our designated providers.

4. Third-Party Data Processors

To provide our services, we utilize specific third-party platforms. By using our website, you acknowledge and agree that your data will be transferred to and processed by the following entities:

  • System.io: Our primary platform for website hosting, course delivery, and membership management.

  • Notion: Our primary tool for data intake, "Strategic Alignment" forms, and project tracking.

  • Google Gemini: Our AI processor for data analysis and strategic drafting.

  • Note: We utilize enterprise-grade settings to ensure your data is not used to train public AI models.

5. Cybersecurity and Limitation of Liability

While ontōlogic implements commercially reasonable security measures (such as SSL encryption and 2FA), no data transmission over the Internet can be guaranteed to be 100% secure.

  • Platform Security: We rely on the security infrastructure of third-party providers (System.io, Notion, and Google) to protect your data. ontōlogic shall not be held liable for any data breaches, unauthorized access, hacking, or data loss resulting from vulnerabilities, failures, or negligence within these third-party platforms.

  • Phishing & Fraud: ontōlogic will never request your password or sensitive banking PINs via email. We are not liable for losses resulting from "phishing" scams or fraudulent activities where a third party impersonates us.

  • User Responsibility: You are solely responsible for maintaining the confidentiality of your login credentials.

6. International Data Transfers

If you access our services from outside the Republic of South Africa, you acknowledge that your information may be transferred to, stored, and processed in servers located in other jurisdictions (primarily the United States, where System.io and Notion maintain servers). By using our services, you explicitly consent to this transfer.

7. Your Rights (POPIA Compliance)

In accordance with South African law, you possess the right to:

  • Request access to the personal record we hold about you.

  • Request the correction, update, or deletion of your personal information.

  • Object to the processing of your personal information for direct marketing.

Terms and Conditions of Service

These Terms and Conditions (“Agreement”) govern the relationship between ontōlogic (“Service Provider,” “we,” or “us”) and you (“the Client” or “Member”). By accessing our website hosted on System.io, submitting data via our Notion forms, or engaging in our Consulting or Community services, you agree to the following:

1. Fees, Late Payments, and Grace Periods

  • Standard Terms: Invoices are due and payable within seven (7) days of the invoice date.

  • Late Fees: Any outstanding balance remaining after the 7-day grace period shall incur a late fee of 5% of the total invoice amount per week (or part thereof) until the balance is cleared.

  • Service Suspension: We reserve the right to suspend all sessions, community access, and workflow implementation if any payment exceeds 14 days past the invoice date.

2. AI Disclosure

  • AI Integration (Gemini): We utilise Google Gemini to assist in research and data synthesis. While we strive for accuracy, AI can produce errors. You acknowledge that all AI-assisted insights are for informational purposes and should be verified before making critical business decisions.

  • Community: Access to the ontōlogic community is a revocable license. We reserve the right to modify features or platforms at our discretion.

3. Cancellation, Rescheduling & Refund Policy

  • Rescheduling (24-Hour Rule): Clients may reschedule a booked session provided they provide at least 24 hours' notice.

  • Rescheduling Limit: To maintain workflow integrity, a single booking may only be rescheduled a maximum of three (3) times. Beyond this limit, the session is forfeited without a refund.

  • Repurposing Meetings: Clients are welcome to repurpose the agenda of their scheduled meetings to address different business needs, provided the new scope remains within our expertise.

  • Forfeiture: Failure to provide 24 hours' notice or "no-shows" will result in the forfeiture of the session fee.

  • No Refunds: We maintain a strict no-refund policy. Once services are booked or work has been performed, all fees are non-refundable.

4. Intellectual Property & Usage License

  • Ownership: All "Booking Manuals," SOPs, templates, and digital resources are the exclusive Intellectual Property of ontōlogic.

  • Limited License: Members are granted a non-exclusive, non-transferable license for internal business use only.

  • Prohibited Acts: You are strictly prohibited from reselling, sub-licensing, or distributing our proprietary "secret sauce" to third parties. "Leaking" community resources will result in immediate termination and potential legal action.

5. Cybersecurity & Third-Party Platforms

  • Platform Dependency: We utilize System.io (hosting) and Notion (data management). While we implement strict security protocols, we are not liable for security breaches, "hacking," or service interruptions caused by these third-party providers.

  • Credential Security: You are responsible for the security of your login credentials. Any activity occurring under your account is your legal responsibility.

  • Data Handling: By using our Notion-integrated forms, you consent to your data being processed within the Notion and System.io ecosystems.

6. Limitation of Liability

  • Cap on Liability: The Service Provider's total liability for any claim arising out of this Agreement shall be limited to the total amount of fees actually paid by the Client to the Service Provider.

  • No Consequential Damages: In no event shall we be liable for lost profits, loss of data, AI-generated inaccuracies, or any indirect damages, even if advised of the possibility.

7. Community Conduct & Non-Solicitation

  • Conduct: Harassment, spamming, or "trolling" is strictly prohibited.

  • Non-Solicitation: Members may not use community directories to solicit other members for competing services or to "poach" clients from the Service Provider. Violation results in immediate removal without refund.

8. Dispute Resolution & Governing Law

  • Good Faith Negotiation: Parties agree to first attempt to resolve disputes through good-faith negotiation and neutral mediation before pursuing litigation.

  • Governing Law: This agreement is governed by the laws of the Republic of South Africa.
